On March 1, in Hanoi, the Drafting Board and Editorial Team of the Decree amending and supplementing a number of articles of Decree 3/06/ND-CP stipulating the mitigation of greenhouse gas emissions and protection of Ozone (Decree) meeting at the headquarters of the Ministry of Natural Resources and Environment (Ministry of Natural Resources and Environment).

Many issues have been proposed to be amended and supplemented to clarify the roles and responsibilities of relevant parties in mitigating greenhouse gas emissions and protecting the ozone layer; regulations on carbon credit management and create conditions for the development of the carbon market in Vietnam.

Mr. Tang The Cuong, Director of the Department of Climate Change (Ministry of Natural Resources and Environment) - Deputy Head of the Drafting Committee, Head of the Editorial Team chaired the meeting. Attending were representatives of units who are members of the Drafting Committee and Editorial Team of the Decree according to Decision No. 309/QD-BTNMT dated January 31, 1 of the Ministry of Natural Resources and Environment.

Presenting the contents expected to be amended and supplemented, Mr. Nguyen Van Minh, Secretary of the Decree's Editorial Team, said: Regarding greenhouse gas emissions mitigation and the carbon market, it is expected that the Decree will supplement Supplementing criteria for establishments emitting greenhouse gases to conduct a greenhouse gas inventory for the agricultural and rural development sectors, specifically livestock farming and agricultural product processing activities. In addition, adding regulations on the responsibilities of the Provincial People's Committee in conducting greenhouse gas inventories; Develop and implement a plan to reduce greenhouse gas emissions.

Regarding greenhouse gas quota allocation, the new Decree will supplement regulations on how to allocate greenhouse gas emission quotas to establishments, including regulations based on the establishment's greenhouse gas emission history. facility to participate in the domestic carbon market. In addition, additional regulations on emission thresholds for establishments subject to emission ceilings; Identify sectors participating in the ETS quota trading system (with facilities subject to emission ceilings) for the period ending 2027; regulations on principles and roadmaps to expand the scope of fields and emission thresholds of establishments for the period from 2028 and after 2030. According to Mr. Minh, from international experience, the first phase only selects Large emission fields with a full database to calculate, determine and allocate quotas such as thermal power, iron and steel.

Regarding carbon credit confirmation and greenhouse gas emission quotas traded on the domestic carbon market exchange, the Decree will clearly stipulate the types of carbon credits that can be offset; Supplementing regulations on the national registration system for carbon credits (managing agency, registration method; subjects required to register, information on greenhouse gas emission quotas and carbon credits must be reporting on the system...) and adding regulations on carbon credit ownership.

The new decree will also add regulations on voluntary trading floors; Detailed regulations on borrowing, transferring, withdrawing, paying back, exchanging quotas, when allowed to sell, validity period of quotas, free allocation, auction; Adding regulations on the exchange of carbon credits, results of reducing greenhouse gas emissions internationally as well as regulations on the mechanism for exchanging and compensating domestic carbon credits...

According to Mr. Minh, currently, many countries want to cooperate in implementing carbon credit exchange agreements, resulting in bilateral greenhouse gas emissions reductions with Vietnam according to the provisions of the Paris Agreement. Therefore, there is a need for regulations to ensure consistent implementation of bilateral cooperation activities. In addition, the new regulations will also create conditions for greenhouse gas emitting facilities to have more options regarding domestic carbon credit standards in addition to international carbon credit standards.

Regarding ozone layer protection, the new Decree will supplement a roadmap for management of manufactured and imported products and equipment that use controlled substances for more synchronous implementation. Supplementing regulations on management and monitoring of controlled substances after recycling. Regarding diploma and certificate requirements for technicians, it is expected to abolish the content on "certificate of completion of training course on collection and treatment of controlled substances according to the program issued by the Ministry of Labor - War Invalids and Social Affairs presides and coordinates with the Ministry of Natural Resources and Environment to build"; Add content related to vocational skills certification activities for technicians working in fields related to controlled substances.

In addition, the Decree will also have additional regulations to support and encourage the implementation of recycling of controlled substances and the implementation of the Global Cooling Commitment that Vietnam participated in at the COP Conference. 28.

At the meeting, representatives of the Ministries of Transport, Industry and Trade, Planning and Investment, Foreign Affairs, Agriculture and Rural Development, Justice, Finance, and Construction; Representatives of the Vietnam Confederation of Commerce and Industry (VCCI) and leaders of relevant units under the Ministry of Natural Resources and Environment discussed and commented on proposed issues for amendment and supplementation. Opinions said that, because there are many new issues, the Decree needs to clarify the concepts and scope stated in the Decree to clearly define the management responsibilities of ministries, branches and localities and create favorable conditions when organizing implementation.

Carbon market regulations need to be clear for emissions quota goods and carbon credits, as well as specific content for domestic transactions and international credit sales. In particular, focus on ensuring transparency issues to avoid double counting of credits in transactions. The Decree also needs to clearly state the areas that will be allocated quotas in the first phase of market implementation.

Receiving comments at the meeting, Mr. Tang The Cuong said that the development of a draft Decree amending and supplementing Decree 06 will ensure political, legal and practical foundations. In parallel with developing the draft Decree, in the coming time, the Department of Climate Change will organize the development of a draft Decree and related documents. In particular, develop a report to review and evaluate the implementation of Decree 06 to have a basis for proposing amendments and supplements; Ensure compliance with regulations on developing and promulgating normative documents on policy, economic and social impact reporting...

Mr. Cuong also requested members of the Drafting Committee in specialized agencies under the Ministries and in the Ministry of Natural Resources and Environment to coordinate with units under the Department of Climate Change to complete the content of the draft Decree, ensuring the deadline for organizing the Decree. The organization collects opinions widely from agencies, organizations and individuals.
