Greenhouse gas inventory (GHG) is the activity of collecting information and data on greenhouse gas emission sources, calculating greenhouse gas emissions and greenhouse gas absorption within a specified range and in a specific year according to the method and process issued by the competent authority. This is an extremely important activity, so each country has regulations on this issue. Accordingly, the following article of GREEN IN will compile the legally required greenhouse gas inventory regulations.
1. Law on Environmental Protection 2020 (Law No. 72/2020/QH14)
Law on Environmental Protection 2020 (Law No. 72/2020/QH14) effective from January 01, 01. Accordingly, enterprises in the List of greenhouse gas emission facilities must conduct greenhouse gas inventories.
Theo Section 7, Article 91, Law on Environmental Protection 2020 has the following provisions:
“Greenhouse gas emission facilities on the list required to conduct greenhouse gas inventories have the following responsibilities:
a) Organize the implementation of greenhouse gas inventories, build and maintain a greenhouse gas emissions database system and send the results of the greenhouse gas inventories every two years to the Ministry of Natural Resources and Environment before December 02 of the reporting period for synthesis and reporting to the Prime Minister;
b) Develop and implement an annual greenhouse gas emission reduction plan; integrate greenhouse gas emission reduction activities into the quality management program, cleaner production program, and environmental protection program of the facility;
c) Annually, prepare a report on greenhouse gas emission reduction levels to implement the facility's greenhouse gas emission reduction plan according to the measurement, reporting and appraisal system and send it to the Ministry of Natural Resources and Environment and relevant Ministries, ministerial-level agencies and provincial People's Committees before December 31 of the reporting period."
2. Circular No. 96/2020/TT-BTC on Guidance on information disclosure on the stock market
Theo Section 2, Article 10, Circular No. 96/2020/TT-BTC Effective from February 01, 02, the content of reporting on greenhouse gas emissions in the Annual Report applicable to public companies is as follows:
“A public company must prepare an annual report according to the form prescribed in Appendix IV issued with this Circular and publish this report within 20 days from the date of publication of the audited annual financial report, but not exceeding 110 days from the end of the fiscal year.
Financial information in the annual report must be consistent with the audited annual financial statements”.
3. Decree No. 06/2022/ND-CP dated January 07, 01 of the Government on Regulations on Mitigation of Greenhouse Gas Emissions and Preservation of the Ozone Layer
Theo Article 6, Decree 06/2022/ND-CP Regulations on the development and updating of the list of sectors and facilities required to conduct greenhouse gas inventories include:
“Greenhouse gas emitting facilities that must conduct greenhouse gas inventories are facilities with annual greenhouse gas emissions of 3.000 tons of CO2 equivalent or more or fall into one of the following cases:
a) Thermal power plants and industrial production facilities with total annual energy consumption of 1.000 tons of oil equivalent (TOE) or more;
b) Freight transport business companies with total annual fuel consumption of 1.000 TOE or more;
c) Commercial buildings with total annual energy consumption of 1.000 TOE or more;
d) Solid waste treatment facilities with annual operating capacity of 65.000 tons or more.”
4. Decision No. 13/2024/QD-TTg of the Prime Minister dated August 13, 08 promulgating the list of sectors and facilities emitting greenhouse gases that need to conduct greenhouse gas inventories (updated)
At the request of the Minister of Natural Resources and Environment, the Prime Minister issued a Decision on the list of sectors and facilities emitting greenhouse gases that must conduct greenhouse gas inventories (updated).
Theo Appendix II, III, IV, V in Decision No. 13/2024/QD-TTg According to the Prime Minister's Decision dated August 13, 08, up to 2024 greenhouse gas emitting facilities in the industry and trade sector, 1805 facilities in the transportation sector, 75 facilities in the construction sector, and 229 facilities in the natural resources and environment sector must conduct GHG inventories.
5. Circular 17/2022/TT-BTNMT Technical regulations on measurement, reporting, appraisal of greenhouse gas emission reduction and greenhouse gas inventory in the waste management sector
On November 15, 11, the Ministry of Natural Resources and Environment issued Circular No. 17/2022/TT-BTNMT Technical regulations on measurement, reporting, verification of greenhouse gas emission reduction and greenhouse gas inventory in the waste management sector. The Circular applies to organizations and individuals involved in the waste management sector and waste treatment facilities.
The Circular stipulates that greenhouse gas inventory work needs to be carried out at the field and grassroots levels.
At the field level, the inventory implementation process includes the following steps:
- Determine inventory method
- Select emission factor
- Collect performance data
- Calculating greenhouse gas emissions and absorption
- Inventory quality control
- Ensure inventory quality
- Assessing uncertainty
- Recalculate and develop reports for national greenhouse gas inventories by sector
6. Circular No. 38/2023/TT-BCT of the Ministry of Industry and Trade: Technical regulations on measurement, reporting, appraisal of greenhouse gas emission reduction and greenhouse gas inventory in the Industry and Trade sector
On December 27, 12, the Ministry of Industry and Trade issued Circular No. 38/2023 Guidance on greenhouse gas inventories for industrial and commercial sectors such as steel, energy, coal mining... and effective from February 11, 02.
The Circular applies to facilities emitting greenhouse gases that must inventory greenhouse gases according to the Prime Minister's Decision, agencies, organizations and individuals involved in GHG inventory activities, measurement, reporting and assessment of GHG emission reduction in the Industry and Trade sector according to the provisions of law. It also outlines the principles for implementing GHG inventory and measurement, reporting and assessment of GHG emission reduction and the technical process for GHG inventory.
7. Circular 23/2023/TT-BNNPTNT Regulations on measurement, reporting, appraisal of greenhouse gas emission reduction results and greenhouse gas inventory in the forestry sector
Minister of Agriculture and Rural Development issued Circular 23/2023/TT-BNNPTNT On December 15, 12, regulations on measurement, reporting, and verification of greenhouse gas emission reduction results and greenhouse gas inventory in the forestry sector were issued.
This Circular applies to organizations and individuals involved in measuring, reporting, and assessing greenhouse gas emission reduction results and greenhouse gas inventories in the forestry sector. The Circular takes effect from February 01, 02.
