1.1 The website https://greeninvietnam.org/ is operated by Green Innovation Joint Stock Company (GREEN IN), its affiliates and related organizations (individually referred to as “GREEN IN Vietnam”, and collectively referred to as “We”, “Our” in this document). GREEN IN Vietnam is committed to respecting the privacy and personal matters of all Users on the GREEN IN Vietnam website (“Website”) (We refer to the Website and the services We provide described on the Website collectively as the “Services”). We recognize the importance of the personal data you have entrusted to Us and believe that it is Our responsibility to properly manage, protect and process your personal data. This Privacy Policy (the “Privacy Policy” or “Policy”) is intended to provide you with general information about how We collect, use, disclose or otherwise process the personal data you provide to Us, whether now or in the future; and how We will assist you before making any decisions regarding providing your personal data to Us. 1.2 By using the Services, registering an account with Us, visiting Our Website, or accessing the Services, you acknowledge and agree to the terms of this Privacy Policy and the Personal Data Protection and Processing Consent Agreement. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, PLEASE DO NOT USE OUR SERVICES OR ACCESS OUR WEBSITE. If We change our Privacy Policy, We will post such changes or modifications on Our Website. We reserve the right to modify this Privacy Policy at any time.

2. WHEN DOES GREEN IN VIETNAM COLLECT INFORMATION?

2.1 “Personal data” means information in the form of symbols, letters, numbers, images, sounds or similar forms in an electronic environment that is associated with a specific person or helps to identify a specific person.

2.2 We will/may collect your Personal Data in the event that:
(a) When you register and/or use Our Services or Website, or open an account with Us;
(b) When you submit any form, including but not limited to application forms or other forms relating to any of Our products and services, whether online or by other form of delivery;
(c) When you enter into any agreement or provide us with any documentation or information relating to your interactions with us, or when you use our products and services;
(d) When you interact with Us, such as through telephone calls (which may be recorded), letters, faxes, face-to-face meetings, through social media platforms and emails;
(e) When you use our electronic services, or interact with us through our applications, or use services on our Website. This includes through Cookies that we may deploy when you interact with our applications, Website or Software;
(f) When you make transactions through our services;
(g) When you provide Us with feedback or complaints;
(h) When you submit your personal data to Us for any reason;
The above are just some common cases where We collect your personal data, not all cases where We will collect your personal data.
In addition, We may also obtain your personal data from government agencies, suppliers, service providers, our partners and other third parties, including but not limited to human resource consultants, banks, credit institutions, employment agencies, your relatives or from publicly available information sources.

3. SPECIFIC DESCRIPTION OF HOW INFORMATION IS COLLECTED AUTOMATICALLY

3.1 When you access, use or interact with Our mobile application, Website or Software, We may collect certain information by automated or passive means using a variety of technologies, which may be downloaded to your device and may set/modify settings on your device. The information we collect may include your Internet protocol (IP) address, your computer/mobile device operating system and browser type, browser name/version, type of mobile device, the characteristics of the mobile device, the unique device identifier (UDID) or mobile equipment identifier (MEID) for your device, the address of a referring website (if any), the date/time of your visits to our Website, Software and mobile applications, and sometimes a “Cookie” (which can be disabled using your browser preferences) to help the Website remember your last visit. If you are logged in, this information is associated with your personal account. This information is also included in anonymous statistics to allow us to understand our users’ browsing habits. We may collect, use, disclose and/or process this information for the Purposes (defined below).

3.2 Our mobile applications may collect precise information about the location of your mobile device using technologies such as GPS, Wi-Fi, etc. For most mobile devices, you can withdraw your permission to obtain your location information through your phone settings. If you have questions about how to disable location services on your mobile device, please contact your mobile phone service provider or the device manufacturer.

3.3 Our Website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses Cookies or other features to allow Us or third parties to collect or share information that helps Us improve the Website and the Services We offer, or helps Us offer new services and features. “Cookies” are identifiers We transfer to your computer or mobile device that allow Us to recognize your computer or device and tell Us how and when Our Services or Website are used or visited, by how many people, and to track actions taken on Our Website. We may link cookie information to personal data. Cookies also collect information related to what you have put in your shopping cart and the pages you have viewed. Cookies are also used to deliver content relevant to your interests and to monitor your use of the Website. You may refuse the use of Cookies by selecting the appropriate settings on your browser. However, please note that if you do this you may not be able to use the full functionality of the Website or our Services.

4. WHAT INFORMATION DOES GREEN IN VIETNAM COLLECT?

We will/may collect and process Personal Data about you, including basic personal data and sensitive personal data and data updated, amended and supplemented from time to time, including:
(a) Basic personal data includes full name, date of birth, gender, place of birth, permanent address, contact address, nationality, image, phone number, email, identity card/citizen identification card/passport/other identification documents, name and address of your workplace, position, information about family relationships, digital account, Personal data reflecting activities, history of activities on cyberspace, other information and data associated with an individual or helping to identify a specific individual and other information and data as prescribed by law; and
(b) Sensitive personal data includes health and privacy status, race, ethnicity, genetic characteristics, physical attributes, biometric information (fingerprints), employment status, data on crimes, criminal acts, customer information of credit institutions, foreign bank branches, payment intermediary service providers, other authorized organizations, including: account information, deposit information, deposit information, transaction information, information on organizations and individuals who are guarantors at credit institutions, bank branches, payment intermediary service providers; data on the location of individuals identified through positioning services, other data prescribed by law as specific and requiring necessary security measures.

5.HOW DO WE USE THE INFORMATION YOU PROVIDE?

5.1 We may collect, use, disclose and/or process your personal data for one or more of the following Purposes:
(a)Authenticate, identify you, review and/or process your request/transaction with Us, evaluate and assess to enter into a Contract;
(b)To manage, operate, provide and/or administer the performance of the Agreement, use of and/or access to Our Services, Software or Website;
(c) Contact us to exchange, notify, market, provide information about products and services (including products and/or services of third parties that We collaborate or work with) that We are selling, marketing or promoting, whether such products or services exist or will be created in the future, information about the latest promotions and offers and conduct care, support and consulting services for you (through forms such as phone calls, sending letters, sending emails, sending SMS/MMS messages and other forms of interaction);
(d) Research, analyze, and develop services (including statistics, data analysis, surveys, reports, product and service development and/or construction) to improve the quality of our services, improve your experience when using the services, and provide suitable products and services to you;
(e)To maintain and administer any software updates and/or other updates that may be required from time to time to ensure the smooth operation of Our services;
(f) Receive and contact to answer questions, handle your requests and complaints against Us;
(g)Implement controls, manage risks, prevent and investigate any fraud, unauthorized activity, omission or misconduct, whether relating to your use of Our Services or any other matter arising from your relationship with Us, whether or not there is any suspicion of such conduct.
(h) Dispute resolution, litigation activities;
(i) Issue invoices and documents in accordance with the provisions of law;
(j)Ensure public security and labor safety, protect personal safety, rights, property or safety of others;
(k)To comply with regulations relating to the security of our systems and the protection of your personal data;
(l)Audit our services or business operations;
(m) Perform legal obligations or as required by competent State agencies;
(n) Carry out other purposes related to our business, operations, management and compliance in accordance with the provisions of law from time to time.

5.2 Some of the Purposes for which we collect, use, disclose or process your personal data depend on the circumstances at the time of collection and may not appear in the list above. However, we will notify you of such Purposes at the time of obtaining your consent, unless the processing of personal data without the consent of the data owner is required by law.

6.HOW WILL GREEN IN Vietnam PROCESS PERSONAL DATA?

6.1 Your Personal Data will/may be processed by Us in any manner according to Our policies from time to time depending on each product, service, Purpose, including but not limited to, collecting, recording, analyzing, validating, storing, editing, combining, accessing, retrieving, recalling, encrypting, decrypting, copying, sharing, transmitting, providing, transferring, using cyberspace, devices, electronic means or other forms to transfer Personal Data domestically and/or abroad, deleting, destroying and other related actions.
6.2 Your personal data and/or information may be transferred, stored, processed in Singapore where Our servers, locations and central databases are operated or will be transferred to the United States where Google servers are located. The data protection and other laws of Singapore and other countries may differ from those of Vietnam. By using Our Website or purchasing Our products or services, you acknowledge that your personal data and/or information may be transferred to Our facilities and to third parties with whom We share it as described in this Privacy Policy.

7. HOW DOES GREEN IN VIETNAM PROTECT USER INFORMATION?

7.1 We implement a variety of security measures to maintain the safety of your personal data in our possession or under our control. Your personal data is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the personal data confidential. When you access your personal data, we provide the use of a secure server. All personal data or information you supply is encrypted into our databases to be only accessed as stated above.

7.2 We will retain personal data in accordance with applicable law and will destroy or anonymize your personal data as soon as (i) the Contract between you and Us expires, or (ii) You stop using Our products/services, (iii) the Purpose of Data Processing is completed or no longer necessary, or (iv) We receive a written request to terminate data processing from a competent state agency, or (v) You decide to withdraw your consent after you have completed the procedures prescribed by law, and/or (vi) in accordance with Our policies applicable from time to time. However, even if you stop using the Software or Website, or your permission to use the Website and/or Services is terminated, we may continue to store, use and/or disclose your personal data in accordance with the Privacy Policy and Our obligations under the regulations.

8. DOES GREEN IN VIETNAM DISCLOSE YOUR PERSONAL INFORMATION TO OUTSIDE PARTIES?

8.1 In the course of our business, we will/may need to disclose your personal data to third party service providers to us, our agents and/or our affiliates or related corporations, and/or other third parties, regardless of where their Websites are located, for one or more of the above Purposes. Such service providers, agents and/or affiliates or related corporations and/or other third parties will be processing your personal data on our behalf or otherwise for one or more of the above Purposes. Such third parties include:
(a)Our affiliates/parent companies/subsidiaries and related companies;
(b)Contractors, agents, service providers and other third parties that We use to support Our business, including but not limited to those providing administrative or other services such as postal companies, telecommunications companies, information technology companies, programming and data centers;
(c)An assignee in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of GREEN IN Vietnam's assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which your personal data is among the assets transferred; or to a counterparty in a business asset transaction that GREEN IN Vietnam or any of its affiliates or related corporations is involved in;
(d) Competent authorities in Vietnam, organizations or individuals requesting information in accordance with Vietnamese law;
(e) Other related parties that We deem necessary to meet the product/service requirements, protect Our legitimate rights and interests, yours or We assess that there is a legal basis to provide your personal data.

8.2 In addition to the above, your information may also be transferred by Google to third parties who process the information on Google's behalf in accordance with the law. Google will not associate your IP address with any other data held by Google.

8.3 This Privacy Policy is not a promise that your personal data will never be disclosed, except as described in this Privacy Policy. In the process of processing Personal Data, We and our related parties are committed to applying technical, security and confidentiality measures necessary and within our ability to protect your Personal Data in accordance with Vietnamese law. However, no technical system or security and confidentiality measures are absolutely safe and online transactions, cyberspace and forms of processing Personal Data always have potential risks arising from destructive and sophisticated actions by disgruntled subjects and not due to our fault, including but not limited to, data not working or working not as expected, data being leaked, distributed, exploited, appropriated or misused.
We are not responsible for risks that may occur during the processing of personal data due to objective causes beyond our control.

9. DISCLAIMER ABOUT SECURITY AND THIRD-PARTY WEBSITES/APPLICATIONS

9.1 In an effort to provide you with added value, we may choose various third party websites to link to, and frame within, the Site. We may also enter into co-branding and other relationships to provide e-commerce and other services and features that we create. These linked sites have separate and independent privacy policies and security agreements. Even if the third party is affiliated with us, we have no control over those linked sites, which have separate and independent privacy and data collection practices. Data collected by our co-brand partners or third party websites (even if offered on or through our Site) may not be received by us.

9.2 We therefore do not guarantee the security of personal information and/or other information you provide to third party websites, and are not responsible for the content, security arrangements and activities of linked websites. Linked websites are provided for your convenience only and you therefore access them at your own risk. However, we seek to protect the integrity of our Website and the links placed upon it and we welcome any feedback about linked websites (including if a particular link does not work). We encourage you to carefully read the terms and other policies provided by third parties on their Websites and other media.

10.HOW CAN YOU ACCESS, CORRECT, DELETE YOUR PERSONAL DATA, WITHDRAW YOUR CONSENT TO THE PROCESSING OF YOUR PERSONAL DATA, REQUEST RESTRICTION OR OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA THAT YOU HAVE PROVIDED TO US?

10.1 You have the right to know, consent, provide, access, correct, delete Personal Data, withdraw consent to the processing of Personal Data, request restriction or object to the processing of your Personal Data, the right to complain, denounce, initiate a lawsuit, the right to claim compensation for damages and the right to self-defense, unless otherwise provided by law. Withdrawal of consent will not affect the lawfulness of the data processing that was agreed to before the withdrawal of consent.

10.2 To exercise your rights above, please let Us know by sending a legally signed document by post to Our head office address in Hanoi, or by emailing Our Customer Care department at support@GREEN IN Vietnam.vn

10.3 Once we have clear instructions about your request and have verified your identity, We will not collect, use and/or disclose your personal data in the manner set out in your request and/or will process your request within 30 days. Where We are unable to respond to you within 30 days, We will notify you as soon as possible within the scope of our ability to do so.

10.4 If We are unable to verify your identity or understand your instructions, We will contact you to clarify your request.

10.5 However, your exercise of the above rights may affect GREEN IN Vietnam's ability to provide services under the Contract and result in: (i) not being able to use the service, or (ii) only being able to use part of the service, or (iii) using the service with undesirable quality, or (iv) not being informed about product/service information or promotional programs, or (v) causing the Contracts between the parties to be interrupted or terminated. Therefore, We may ask you to withdraw these requests.

11. YOUR OBLIGATIONS

11.1 Read and understand the provisions of each Term of this Privacy Policy.
11.1. Protect your Personal Data yourself; request other relevant organizations and individuals to protect your Personal Data.
11.2. You are responsible for providing Us with Personal Data that is lawful, complete, accurate and up-to-date at the time of provision.
11.3. Your instructions regarding the processing of Personal Data must be consistent with the Contract and comply with all applicable Data Protection Laws, including the appointment of Us as another processor, as authorised by the relevant controller. You are responsible for the lawfulness of the Personal Data and the means by which you receive the Personal Data. We will not be required to comply or follow your instructions if they are in breach of Data Protection Laws.
11.4. If you are not the data subject, you must ensure that the data subject has given explicit consent to all activities of data collection, use and provision of information to Us as well as understand the ways in which We process personal data. Store evidence proving the consent of the data subject as prescribed in this clause and provide this evidence upon request by Us. You are responsible for compensating Us for damages caused by your failure to comply with the provisions of this section.

12.3 If you submit a complaint request via letter or email, please include the information about the complaint regarding the application of the law related to personal information security in the subject line of the email. This will help Us to process your request quickly by transferring it to the responsible department within Our company for further processing. For example, you can add the content “Complaint regarding the application of the law” in the subject line of the email/letter.
We will endeavour to deal with your complaint or grievance as soon as possible.

13. GOVERNING LAW

This Privacy Policy is governed by the laws of the Socialist Republic of Vietnam.
